DMCA Copyright Policy

MemeSounds has adopted the following general policy toward copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA). The address of the Designated Agent to Receive Notification of Claimed Infringement ("Designated Agent") is listed at the end of this policy.

Procedure for Reporting Copyright Infringement

If you believe that material residing on or accessible through MemeSounds infringes a copyright, please send a notice of copyright infringement containing the following information to our Designated Agent:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed.
  2. Identification of the copyrighted work or material that has been infringed.
  3. Identification of the material that is claimed to be infringing, including information regarding its location, with sufficient detail so that MemeSounds can find and verify its existence.
  4. Contact information of the notifier, including address, telephone number, and email address (if available).
  5. A statement that the notifier has a good faith belief that the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information provided is accurate and that the notifying party is authorized to make the complaint on behalf of the copyright owner.

If we receive a takedown notice that complies with the above requirements, we will remove the cited material and attempt to notify the user who uploaded the allegedly infringing material, if applicable. Users will have the opportunity to submit a counter-notice as outlined below. Repeated infringement of intellectual property rights may result in the termination of user accounts.

Procedure to Deliver Counter-Notice

If you believe that material removed is not infringing or that you have the right to post and use such material, you may send a counter-notice containing the following information to the Designated Agent:

  1. A physical or electronic signature of the user.
  2. Identification of the material that has been removed and the location where it appeared before removal.
  3. A statement that the user has a good faith belief that the material was removed due to mistake or misidentification.
  4. The user's name, address, telephone number, and email address (if available), along with a statement consenting to the jurisdiction of the Federal Court for the judicial district in which the user’s address is located. If outside the United States, the statement must consent to any jurisdiction where MemeSounds is located and that the user will accept service of process from the complaining party.

If a counter-notice is received, MemeSounds will forward a copy to the original complaining party. If we do not receive notice within 10 days that legal action has been filed, we may restore the removed material at our discretion.
